How Family Law in South Carolina Is Different
South Carolina makes it more difficult to obtain a divorce than in many other states by imposing a mandatory separation period before you are allowed to file for divorce.
There are two options for divorce in South Carolina: the no-fault option or the fault option. Essentially, if the cause for the divorce is not a reason such as adultery, physical cruelty, habitual drunkenness or drug use, or desertion by one spouse for at least a year, then the divorce is a no-fault divorce.
To file a no-fault divorce in South Carolina, spouses must live apart for one year. And once you file for divorce, there’s a minimum 3-month waiting period before the divorce decree may be issued. There are also some residency requirements that may increase the time you must wait before filing if you want to file in South Carolina. Other states also have mandatory waiting periods before filing for divorce, but in most other places, the waiting period may be waived by mutual consent.
For an at-fault divorce, the process is much faster. If all issues have been resolved on a final basis, a divorce decree may be obtained 90 days after filing.
Also, like most states, family courts in South Carolina prefer to find a visitation or custody solution that allows both parents to see the child or children frequently and on a continued basis.
And like most states, both parents are expected to support their children after a divorce. Child support has clear guidelines under federal law, and so is reasonably easy to predict.
But family court judges in South Carolina are given great discretion when it comes to distribution of property, child custody, and alimony, and so divorce cases frequently go to trial and try their luck with a judge rather than settling.
